Dentons to give an update on the new Privacy Act

On 1 December 2020, the Privacy Act 2020 will come into force, repealing and replacing the Privacy Act 1993. The world has changed a lot since the 1993 Act was passed, with more and more organisations – including those operating in the financial advice industry – making the move to an online presence. In doing so, these organisations are collecting more and more personal information about their customers, which information is faced with an ever-growing list of threats of misuse and unauthorised access. We have Campbell Featherstone and David Ireland Join us to talk about

– The global context in which the Privacy Act 2020 has been enacted

– The key changes to New Zealand privacy law introduced by the Act (and how they interact with the law applicable to financial advisers, including FSLAA)

– Trends in the application of privacy law, both in New Zealand and overseas, and how that may shape the ‘customer journey’ for an adviser’s client

– The importance of ‘getting things right’ in the age where consumer trust in your data handling practices is paramount

Campbell Featherstone is a senior associate in Dentons Kensington Swan’s technology and innovation team, who has a focus on technology, IT, outsourcing and privacy. Campbell led the firm’s written and oral submissions to the Justice Select Committee on the Privacy Bill, and was part of the team consulted by the Ministry of Justice in connection with the Departmental Report on the Bill. He is also the co-author of the Thomson Reuters practice note Digital Business in New Zealand.

David Ireland is a partner in the Dentons Kensington Swan banking and financial markets team. He has been at the forefront of the extensive regulatory reforms impacting the provision of financial advice services for many years, and has chaired the Financial Advisers Code Committee since 2012.
